Terms and conditions
In connection with the Open Market Tender Operations System (OMTOS), the following terms and conditions must be observed; the relevant documents are available for download:
- The Guideline on the implementation of the Eurosystem’s monetary policy framework (ECB/2014/60, as last amended by Guideline (EU) 2015/510/679) forms the basis for the Eurosystem’s monetary policy operations.
- The Deutsche Bundesbank’s General Terms and Conditions implement the Eurosystem’s requirements and determine the fundamental legal relationships between the Deutsche Bundesbank and the bidders. They form the external framework for OMTOS.
- The Tender Terms define the details of the bidding process in OMTOS.
- The General Terms and Conditions for the Bundesbank ExtraNet form the framework for using the Bundesbank ExtraNet, which provides access to OMTOS. These are supplemented by Section I (3) of the Tender Terms ("Access to OMTOS") to the effect that, in particular, the use of function users and the possibility of transferring an authorisation by changing the first name and name of the user are expressly excluded for OMTOS.
- The Bundesbank’s terms and conditions for US dollar credit operations under a “Special facility of the Eurosystem” govern liquidity-providing operations in USD in the form of secured credit operations against ECB-eligible collateral. Note on the user management
At this point, we would like to point out emphatically that changes to the user’s name and first name and thus the passing on of the user ID, which are technically possible in ExtraNet and described in the documentation, are expressly excluded in the OMTOS Special Regulations on the ExtraNet General Terms and Conditions. The same applies to the use of the function user provided for in ExtraNet.
