Submission of drawn up and adopted annual accounts pursuant to Section 26 of the Banking Act (Kreditwesengesetz – KWG), Section 22 of the Payment Services Supervision Act (Zahlungsdiensteaufsichtsgesetz – ZAG),Section 76 of the Investment Firm Act (Wertpapierinstitutsgesetz – WpIG), Section 32 Secondary Credit Market Act (Kreditzweitmarktgesetz – KrZwMG) and Section 38 Cryptomarkets Supervision Act (Kryptomärkteaufsichtsgesetz – KMAG). Submission of auditor engagement notifications pursuant to Section 28 KWG, Section 23 ZAG and Section 77 WpIG, Section 33 KrZwMG and Section 39 KMAG. In addition to the requirement to submit the relevant documents to the Bundesbank via the business topic “Prudential notifications and returns – upload documents” in the Bundesbank’s NExt Portal, there is also the specialised procedure “Banking supervision” for KWG and ZAG filings in BaFin’s MVP Portal. A specialised MVP procedure for WpIG filings is not yet available; submissions can be made by post, fax or email to BaFin, Securities Supervision/Asset Management. Submitting reports or notifications to the Bundesbank therefore does not release reporting entities from the simultaneous obligation to submit them to BaFin as well.
